Privacy Policy.

1.Who we are and scope

Summit Synergies LLC, a Nevada limited liability company operating the Imoptimus brand ("Imoptimus", "Optimus", "we", "us", or "our") provides a privately deployed AI operating system for businesses. We respect your privacy and are committed to handling personal information responsibly.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit www.imoptimus.ai, contact us, request a fit call, communicate with us by email, telephone, SMS, or chat, purchase or use the Optimus service, or otherwise interact with Imoptimus. It also explains, in Section 4, how we handle the business data processed inside a customer's private deployment.

This policy does not apply to websites, applications, or services owned or controlled by third parties. By using our Site or voluntarily providing information to us, you acknowledge that you have reviewed this Privacy Policy.

2.Information we collect

Contact and inquiry information. When you request a fit call, use our forms, check out, or contact us, we may collect your name, email address, telephone number, business name, and the contents of your inquiry.

Qualification information. Our fit-call form asks about your business so we can assess fit before the call: how long the business has been running, team size, an optional monthly revenue range, and a description of what consumes your time. Providing the revenue range is optional.

Communications information. When you communicate with us by email, telephone, SMS, MMS, or chat, we may collect the content of the communication, your number or address, dates, times, and durations, delivery and response information, SMS opt-in and opt-out records, records showing when and how consent was provided, and call recordings or transcripts where permitted by law and after any legally required notice or consent.

Billing and transaction information. If you engage us, we may collect billing name and address, contract and proposal information, invoice and payment status, transaction amounts, payment method type, and partial payment information such as the last four digits of a card. Complete payment-card details are collected and processed by an independent payment processor; Imoptimus does not store full card numbers or security codes on its own systems.

Website and technical information. When you visit the Site, we or our providers may automatically collect IP address, browser and device type, operating system, pages viewed, referring site, access times, approximate location derived from IP, cookie or device identifiers, and performance or diagnostic information.

Information from other sources. We may receive information from referral sources, communications providers, payment processors, hosting and analytics providers, publicly available business sources, and other service providers acting on our behalf, and may combine it with information you provide.

3.How we use personal information

  • Respond to inquiries and assess fit for our services.
  • Schedule and conduct fit calls; prepare proposals, order forms, and agreements.
  • Provide, operate, secure, and improve the Optimus service and the Site.
  • Onboard your deployment, provide support, and send service-related updates, briefings, confirmations, and reminders.
  • Process invoices and payments and maintain business, tax, and accounting records.
  • Prevent fraud, abuse, and unauthorized activity; enforce our agreements and policies.
  • Comply with legal, regulatory, tax, and reporting obligations; establish, exercise, or defend legal claims.
  • Send marketing communications only as permitted by law and after obtaining any required consent.
  • Carry out another purpose disclosed to you when the information is collected.

We will not use your information for a materially unrelated purpose without appropriate notice or consent where required by law.

4.Customer business data - private by design

When a customer engages Imoptimus, their deployment connects to tools the customer designates - such as email, calendars, CRM, payments, messaging, storefronts, and documents - and processes the business data inside them ("Customer Business Data"), which may include personal information about the customer's own clients, leads, and staff.

  • The customer owns it. Customer Business Data belongs to the customer. We process it solely to provide the contracted services, under the customer's configured rules and approvals, acting as a service provider or processor on the customer's behalf.
  • One business at a time. Each deployment is private to one business. Customer Business Data is not shared between deployments and is not pooled across customers.
  • No training on your data for others. We do not use Customer Business Data to train models made available to other customers or to the public, and we do not sell it.
  • Subprocessors. Customer Business Data may be processed by infrastructure and AI providers acting as subprocessors solely to deliver the service, under contractual confidentiality and data-protection obligations.
  • Deletion. Upon termination of an engagement, we make exportable Customer Business Data available to the customer for 30 days, after which it is deleted or anonymized, except where retention is required by law.

Individuals whose personal information appears in a customer's deployment should direct privacy requests to that customer, who controls the data; we will assist our customers in responding as required by law.

5.SMS and mobile messaging privacy

How users opt in. Imoptimus sends SMS or MMS messages only when a recipient has provided appropriate consent or when messages are otherwise permitted by law. A person may consent by: providing express verbal consent during a telephone call with an authorized Imoptimus representative; selecting an optional, unchecked SMS-consent checkbox on an Imoptimus form, where offered; sending a text message to an Imoptimus number and requesting a response; or another documented method that clearly identifies Summit Synergies LLC (operating as Imoptimus) as the sender and the types of messages to be received. Consent is voluntary and is not a condition of purchasing goods or services. Where a form is used, the SMS checkbox is separate from any required acceptance of terms and is never pre-selected.

Types of messages. Depending on the consent given, messages may include responses to inquiries, fit call scheduling, appointment confirmations and reminders, onboarding coordination, service-related follow-up, account updates, support, and other communications described when consent is obtained. We do not use a customer-care messaging program to send unrelated unsolicited advertising.

Frequency and charges. Message frequency varies with your inquiries, appointments, and account activity. Message and data rates may apply according to your mobile plan.

Opting out. Reply STOP at any time to unsubscribe. After a STOP request we may send one final confirmation message, and no further messages will be sent unless you provide new consent. Reply HELP, or email info@imoptimus.ai, for assistance.

NO MOBILE INFORMATION WILL BE SHARED WITH THIRD PARTIES OR AFFILIATES FOR MARKETING OR PROMOTIONAL PURPOSES. TEXT MESSAGING ORIGINATOR OPT-IN DATA AND CONSENT WILL NOT BE SHARED, SOLD, RENTED, OR TRANSFERRED TO THIRD PARTIES, AFFILIATES, LEAD GENERATORS, OR DATA BROKERS FOR THEIR OWN MARKETING OR PROMOTIONAL PURPOSES.

Imoptimus may disclose mobile information to service providers that process messages solely on our behalf - telecommunications, messaging, hosting, CRM, and technology providers - who may access it only as necessary to perform contracted services and are not authorized to use it for their own marketing. Imoptimus does not sell mobile telephone numbers or SMS consent records.

6.How we may disclose personal information

Service providers. We may disclose information to vendors performing services on our behalf, including website and cloud hosting, AI model providers, email hosting and delivery, telecommunications and messaging, scheduling, payment processing, accounting, cybersecurity, analytics, technical support, and legal or professional services. Providers may process information only as reasonably necessary to serve Imoptimus and subject to applicable contractual, confidentiality, or legal obligations. Use of service providers never permits mobile opt-in data or SMS consent to be used for independent marketing.

Legal and safety. We may disclose information when we reasonably believe it necessary to comply with law, respond to a subpoena or lawful request, protect the rights, property, or safety of Imoptimus, its customers, or others, investigate fraud or security incidents, enforce an agreement, or establish, exercise, or defend legal claims.

Business transactions. Information may be reviewed or transferred in connection with a merger, acquisition, reorganization, financing, or sale of assets. Mobile opt-in information and SMS consent will not be transferred for a recipient's independent marketing use.

At your direction. We may disclose information when you request, authorize, or consent to the disclosure.

7.Sale or sharing of personal information

Imoptimus does not sell personal information for monetary compensation, does not sell Customer Business Data, and does not sell or share mobile numbers, mobile information, or SMS opt-in records with third parties or affiliates for marketing or promotional purposes.

Certain privacy laws define "sale" or "sharing" broadly and may include some analytics or advertising activity even without payment. Where such laws apply, eligible individuals may opt out by emailing info@imoptimus.ai with the subject line "Privacy Request".

8.Cookies and similar technologies

Our Site may use cookies, local storage, and similar technologies to enable basic functions, remember preferences (such as dark mode), maintain security, understand traffic and usage, identify technical problems, and improve the Site. You may block or delete cookies in your browser settings; blocking some cookies may affect functionality. Where required by law, we will request consent before using non-essential cookies.

9.Analytics

We may use analytics technologies to understand how visitors use the Site. Such providers may collect device, browser, cookie, and interaction information under their own privacy policies. We do not authorize analytics or advertising providers to use mobile opt-in data or SMS consent for their own marketing.

10.Data retention

We retain information for as long as reasonably necessary to respond to inquiries, provide services, maintain business records, fulfill the purposes described in this policy, comply with tax, accounting, legal, and contractual obligations, resolve disputes, enforce agreements, and protect against fraud and abuse. Retention periods vary by information type, relationship, law, and legitimate business need. Customer Business Data follows the deletion timeline described in Section 4. When information is no longer reasonably required, we delete, anonymize, aggregate, or securely dispose of it.

11.Data security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, use, alteration, loss, or disclosure - including access controls, authentication requirements, encryption in transit and at rest where appropriate, isolation of customer deployments, restricted access to business systems, vetted service providers, monitoring and backups, and incident-response procedures. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

  • Connection credentials. API keys, tokens, and credentials that customers provide to connect their tools are stored encrypted, are used only for the connections the customer has authorized, and can be revoked by the customer at any time.
  • Personnel access. Access to customer deployments by our personnel and contractors is limited to what is necessary to operate and support the service, on a least-privilege basis and under confidentiality obligations.
  • Breach notification. If we determine that a security incident has affected your personal information or Customer Business Data, we will notify affected customers, and regulators where applicable, without undue delay and as required by applicable law.
  • Processor commitments. A data processing addendum describing our commitments as a service provider or processor is available to business customers upon request at info@imoptimus.ai.

12.Your privacy rights

Depending on your state or country of residence and subject to applicable law, you may have the right to request access to your personal information, request correction of inaccurate information, request deletion, request a portable copy, withdraw consent, object to or restrict certain processing, opt out of certain sales, sharing, or targeted advertising, and appeal a denial of a request. These rights may be subject to exceptions and verification.

To submit a request, email info@imoptimus.ai with the subject line "Privacy Request". We may request information reasonably necessary to verify your identity, and we will not unlawfully discriminate against you for exercising a right. Residents of California and other U.S. states with comprehensive privacy laws may exercise the rights above; we do not sell mobile information or share SMS opt-in consent for marketing purposes.

13.Children's privacy

Our Site and services are intended for adults and authorized business representatives. We do not knowingly collect personal information directly from children under 13, and the services are not directed to anyone under 18. If you believe a child has submitted personal information to us, contact info@imoptimus.ai so we can review and take appropriate action.

14.Third-party links

Our Site may link to third-party websites or services. We do not control and are not responsible for their privacy, security, content, or practices. Review the privacy policy of any third-party service before providing information to it.

15.International visitors

Imoptimus operates from the State of Nevada, United States. If you access the Site or communicate with us from elsewhere, your information may be transferred to, stored in, or processed in that jurisdiction or in countries where our service providers operate, whose privacy laws may differ from those of your location.

16.Changes to this policy

We may update this Privacy Policy periodically to reflect changes in our business, services, technology, legal obligations, or practices. When we make changes, we will revise the "Last updated" date, and material changes may be communicated through the Site or another reasonable method.
